Responding to a lawsuit by an Alabama death row inmate, a federal appeals court says the state’s use of nitrogen gas to put people to death needs more study to determine whether it violates a constitutional ban on cruel and unusual punishment. The appeals court sent the lawsuit filed by death row inmate Jeffery Lee back to the lower court judge for additional consideration.
